Comprehensive Terms of Service for Mojowell

1. ACCEPTANCE OF TERMS

By downloading, installing, accessing, or using Mojowell ("App," "Mojo," "Service," "Platform," or "we"), you ("User," "you," or "your") agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these Terms, you do not have permission to access the Service.

BINDING ARBITRATION NOTICE: THESE TERMS CONTAIN A BINDING ARBITRATION PROVISION AND CLASS ACTION WAIVER THAT AFFECT YOUR LEGAL RIGHTS. PLEASE READ SECTION 22 CAREFULLY.

2. MEDICAL DISCLAIMER AND HEALTH INFORMATION

CRITICAL HEALTH DISCLAIMERS:

2.1 NOT MEDICAL ADVICE

THE SERVICE DOES NOT PROVIDE MEDICAL ADVICE. The information, including but not limited to text, graphics, images, AI-generated insights, symptom analysis, health scores, and other material contained in this App are for informational and educational purposes only. The content is not intended to be a substitute for professional medical advice, diagnosis, or treatment.

2.2 NO DOCTOR-PATIENT RELATIONSHIP

USE OF THIS SERVICE DOES NOT CREATE A DOCTOR-PATIENT RELATIONSHIP. Always seek the advice of your physician or other qualified health provider with any questions you may have regarding a medical condition.

2.3 MEDICAL EMERGENCIES

THE SERVICE IS NOT FOR EMERGENCIES. If you think you may have a medical emergency, call your doctor, go to the emergency department, or call emergency services (911 in the US) immediately. Never disregard professional medical advice or delay in seeking it because of something you have read in this App.

2.4 AI LIMITATIONS

Our AI-powered features are based on pattern recognition and statistical analysis. They:

  • • Are not infallible and may produce incorrect results
  • • Should not be the sole basis for health decisions
  • • Are not a replacement for professional medical evaluation
  • • May not consider all aspects of your unique medical situation

3. ELIGIBILITY AND ACCOUNT REGISTRATION

3.1 Age Requirements
  • • You must be at least 18 years old to create an account
  • • Family profiles for children under 13 must be created and managed by a parent or legal guardian
3.2 Account Responsibilities

You agree to:

  • • Provide accurate, current, and complete information
  • • Maintain the security of your password and account
  • • Notify us immediately of any unauthorized access
  • • Accept responsibility for all activities under your account
  • • Not share your account credentials with others
3.3 Account Termination

We reserve the right to:

4. DESCRIPTION OF SERVICE

The app provides:

  • • Health score calculations
  • • Health recommendations and insights
4.2 Premium Features

Certain features require a paid subscription:

  • • Unlimited AI consultations

  • • Multiple family profiles
4.3 Service Modifications

We reserve the right to:

  • • Modify or discontinue any feature without notice
  • • Change pricing with 30 days notice
  • • Update functionality based on user feedback
  • • Limit certain features based on usage

5. USER CONDUCT AND PROHIBITED USES

5.1 Acceptable Use

You agree to use the Service only for lawful purposes and in accordance with these Terms.

5.2 Prohibited Conduct

You agree NOT to:

  • • Use the Service for any illegal or unauthorized purpose
  • • Provide false or misleading health information
  • • Impersonate healthcare professionals
  • • Share prescription medications or controlled substances information illegally
  • • Attempt to gain unauthorized access to the Service or its systems
  • • Reverse engineer, decompile, or disassemble the App
  • • Use the Service to harm minors in any way
  • • Upload viruses or malicious code
  • • Spam other users or send unsolicited communications
  • • Violate any applicable laws or regulations
  • • Use automated systems or software to extract data (scraping)
  • • Resell or commercially exploit the Service without permission
5.3 Health Information Accuracy

You acknowledge that:

  • • Providing accurate health information is crucial for proper Service function
  • • False or incomplete information may result in incorrect insights
  • • You are responsible for the accuracy of information you provide

6. INTELLECTUAL PROPERTY RIGHTS

6.1 Our Property

The Service and its original content, features, and functionality are owned by Mojowell/Wymco LLC and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

6.2 Your License to Use

We grant you a limited, non-exclusive, non-transferable, revocable license to:

  • • Download and use the App on devices you own or control
  • • Access and use the Service for personal, non-commercial purposes
6.3 Your Content

You retain ownership of health information you provide, but grant us a license to:

  • • Process your data to provide the Service
  • • Generate insights and recommendations
  • • Improve our algorithms (using anonymized data)
  • • Comply with legal obligations
6.4 Feedback

7. PAYMENT TERMS

7.1 Subscription Fees

  • • Subscriptions auto-renew unless cancelled
  • • Payment is charged to your chosen payment method
  • • No refunds for partial subscription periods
7.2 Free Trial
  • • Free trials automatically convert to paid subscriptions
  • • Cancel before trial ends to avoid charges
  • • Each user is eligible for one free trial only
7.3 Changes to Pricing
  • • We may change prices with 30 days notice
  • • Current subscriptions remain at existing price until renewal
  • • You may cancel if you disagree with price changes
7.4 Refund Policy
  • • No refunds except as required by law
  • • Technical issues may qualify for pro-rated credits
  • • Refund requests must be submitted within 14 days

8. PRIVACY AND DATA PROTECTION

8.1 Privacy Policy

Your use of the Service is also governed by our Privacy Policy, which is incorporated by reference into these Terms.

8.2 Data Security

While we implement industry-standard security measures:

10.2 No Guarantee of Results

We do not warrant that:

  • • The Service will meet your specific health needs
  • • Results will be accurate or reliable
  • • Errors will be corrected

11. LIMITATION OF LIABILITY

11.1 DAMAGES LIMITATION

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL MOJOWELL/WYMCO LLC, ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR:

  • • INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES
  • • LOSS OF PROFITS, DATA, USE, OR GOODWILL
  • • COST OF SUBSTITUTE SERVICES
  • • ANY DAMAGES RESULTING FROM USE OR INABILITY TO USE THE SERVICE
  • • UNAUTHORIZED ACCESS TO YOUR DATA
  • • STATEMENTS OR CONDUCT OF ANY THIRD PARTY
  • • HEALTH OUTCOMES OR MEDICAL DECISIONS
  • • ANY OTHER MATTER RELATING TO THE SERVICE
11.2 MAXIMUM LIABILITY

OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT PAID BY YOU TO US IN THE PAST TWELVE (12) MONTHS OR $100, WHICHEVER IS GREATER.

11.3 ESSENTIAL PURPOSE

THESE LIMITATIONS APPLY EVEN IF THE REMEDY FAILS OF ITS ESSENTIAL PURPOSE OR WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

12. INDEMNIFICATION

You agree to defend, indemnify, and hold harmless Mojowell/Wymco LLC and its subsidiaries, agents, licensors, managers, and other affiliated companies, and their employees, contractors, agents, officers and directors, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees) arising from:

  • • Your use of and access to the Service
  • • Your violation of any term of these Terms
  • • Your violation of any third-party right
  • • False or inaccurate information you provide
  • • Any harm to others resulting from your use of the Service
  • • Your negligent or intentional misconduct

13. ASSUMPTION OF RISK

13.1 Health Decisions

You acknowledge and agree that:

  • • Health decisions based on the Service are at your own risk
  • • Individual results may vary
  • • The Service cannot replace professional medical care
  • • You should verify all information with healthcare providers
13.2 Technology Risks

You accept the risks inherent in:

  • • Internet-based services
  • • Mobile applications
  • • AI and machine learning technologies
  • • Electronic data storage and transmission

14. TERMINATION

14.1 By You

You may terminate your account at any time by:

  • • Using the account deletion feature in the App
  • • Contacting customer support
  • • Ceasing to use the Service
14.2 By Us

We may terminate or suspend your account immediately, without prior notice, if:

  • • You breach these Terms
  • • We are required to by law
  • • Provision of the Service becomes unlawful
  • • We discontinue the Service
14.3 Effects of Termination

Upon termination:

  • • Your right to use the Service ceases immediately
  • • Paid subscriptions are not refunded
  • • Some information may persist in backup copies
  • • Provisions that should survive termination will remain in effect

15. GOVERNING LAW AND JURISDICTION

15.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of USA, without regard to its conflict of law provisions.

15.2 Jurisdiction

Any legal action or proceeding shall be brought exclusively in the courts located in Indianapolis, in the state of Indiana, USA.

16. CHANGES TO TERMS

16.1 Modification Rights

We reserve the right to modify these Terms at any time. Material changes will be notified by:

  • • Email notification
  • • In-app notification
  • • Requiring acceptance for continued use
16.2 Acceptance of Changes

Continued use after changes constitutes acceptance of new Terms. If you disagree with changes, you must stop using the Service.

17. SPECIFIC STATE LAW PROVISIONS

17.1 California Users

Under California Civil Code Section 1789.3, users are entitled to specific consumer rights notices. Complaints may be filed with the Complaint Assistance Unit of the Division of Consumer Services.

17.2 New Jersey Users

Certain provisions (limitation of liability, disclaimer of warranties, indemnification) may not apply to New Jersey consumers.

18. EXPORT COMPLIANCE

You agree not to export or re-export the Service to any country subject to embargo or to any person on prohibited party lists.

19. ACCESSIBILITY

We are committed to ensuring accessibility for people with disabilities and strive to comply with applicable accessibility laws.

20. FORCE MAJEURE

We shall not be liable for any failure to perform due to causes beyond our reasonable control, including but not limited to:

  • • Natural disasters
  • • War or terrorism
  • • Pandemic or epidemic
  • • Government actions
  • • Internet or telecommunications failures

21. MISCELLANEOUS PROVISIONS

21.1 Entire Agreement

These Terms constitute the entire agreement between you and us regarding the Service.

21.2 Severability

If any provision is deemed invalid or unenforceable, the remaining provisions continue in full force.

21.3 Waiver

Our failure to enforce any right or provision is not a waiver of that right or provision.

21.4 Assignment

You may not assign these Terms without our prior written consent. We may assign our rights to any successor or acquirer.

21.6 Relationship of Parties

Nothing in these Terms creates a partnership, joint venture, or agency relationship.

22. DISPUTE RESOLUTION AND ARBITRATION

22.1 Informal Resolution

Before filing a claim, you agree to try to resolve disputes informally by contacting us at info@mojowell.ai.

22.2 Binding Arbitration

If informal resolution fails:

  • • ALL DISPUTES SHALL BE RESOLVED BY BINDING ARBITRATION
  • • Arbitration shall be conducted by JAMS
  • • Arbitration shall occur in Hamilton country, Indiana
  • • Each party bears its own costs
22.3 Class Action Waiver

YOU WAIVE ANY RIGHT TO PARTICIPATE IN CLASS ACTIONS. You may bring claims only in your individual capacity.

22.4 Exceptions

You may bring claims in small claims court if eligible. Either party may seek injunctive relief for intellectual property violations.
